Facultad de Derecho, 2016-12) Agudelo-Giraldo, Oscar Alexis; Riaño-F., Ángela Paola; Agudelo-Giraldo, Oscar AlexisThe legal theory of human rights and fundamental rights requires the need for a global legal system that protects both legal categories without any degree of personalistic distinctions such as citizen and immigrant. Under the global legal order, the union of States represents the disappearance of visible and invisible borders, while nation states are called to disappear. Despite the legal-theoretical construction of the binomial human rights/fundamental rights, which expresses a legal-political delimitation that is alien to national law, border control and closure have persisted in those countries that have emerged as economic powers, leading to the lack of recognition of human rights for those non-citizens who are in the search for the rights that would help them live well. The study proposes then the choice of a particular case under analysis, at the border between Ceuta and Melilla, which will question the claim of universality of human rights. For this purpose, an inductive as well as a deductive and pragmatic methodology will be used to contrast the case of border closures with the current theory of fundamental rights.

Facultad de Derecho, 2018-06) Polo-Alvis, Sebastián; Serrano-López, Enrique; Granados-Vela, Laura AlejandraThis paper aims to understand the current conditions of the Colombian people in Costa Rican society, as well as the social integration processes in the country. By understanding these circumstances, it is possible to have a broader perspective of Colombian migrants in Costa Rica that includes the sociopolitical conditions of the host country's society and that facilitates a greater follow-up of Colombians. By understanding the statistics and demographics of the socioeconomic conditions of the Colombian population in Costa Rica and conducting an ethnographic study on the perspectives and personal experiences of Colombian migrants, we aim to provide the readers with a reliable vision of Colombian migration to that country, framed in a socio-historical analysis of this migration tendency.

Facultad de Psicología, 2013-12) Spring, Úrsula OswaldThis article investigates the impact of women's double vulnerability, the social and environmental vulnerability that makes them household heads, and the processes that enable them to overcome vulnerability and empower themselves at the local level. An empirical study conducted in the Yautepec river basin in the state of Morelos in Mexico explores the impacts of climate change and socio-environmental migration on this rural population. The study combined quantitative and qualitative methods. In the context of the concept of dual vulnerability, environmental and social, the research analysed the relationship between environmental degradation and adverse social conditions, and an Index of Social Vulnerability was developed. The research results showed that when families are faced with a survival dilemma, men migrate, leaving women overburdened with a workload which leads to illness and malaise. At the same time, having assumed the role of household head with all its productive, caring and educational activities, women become empowered. They become involved in local public activities and are able to break up existing corrupt male chiefdoms. In conclusion, the study found that the feminization of agriculture and local public services had allowed women to recover eroded land thanks to organic farming, and to improve public services in their communities.

Los Estados desarrollan políticas para el acceso legal de los inmigrantes; sin embargo, en muchas ocasiones, existe un alto ingreso de migración irregular. En este contexto, el Derecho Público internacional ha desarrollado una serie de estándares para la protección de los derechos de los inmigrantes irregulares. El presente artículo tiene por objeto analizar dichos estándares en el caso colombiano.

Facultad de Derecho, 2017-01) Labriola, Giulia MariaEste ensayo reflexiona sobre la tendencia actual a la proliferación de confines y muros. El fenómeno, que se destaca tanto en el exterior como en el interior del territorio de la Unión Europea, tiene una importancia realmente global. La hipótesis que planteamos atribuye esta tendencia a la afirmación de una segunda fase de la globalización, caracterizada por una nueva necesidad de espacialización. La transformación del confín de línea demarcadora a lugar de prácticas gubernamentales responde a su función de bloque de los flujos migratorios, un incesable proceso de reacción a la desigualdad social, que hoy día se extiende a nivel transnacional. El derecho y los juristas tienen que interpretar y gobernar estos fenómenos complejos.
