Dice Santo Tomás: “La finalidad de la filosofía no es saber lo que los hombres han pensado, sino saber cuál es la verdad de las cosas”. Por ello, el presente libro se desarrolla desde el Realismo Filosófico -como sistema de pensamiento-, seleccionando los temas que pueden ser relevantes para quienes se dedican al estudio de la Filosofía del Derecho, donde el conocimiento toma su impulso hacia lo real, hacia la verdad natural. En consecuencia, téngase presente que habrá siempre una verdad conquistada donde ha habido un auténtico conocimiento desde el estudio de la realidad, con independencia del sujeto pensante y no por cuenta y riesgo del mismo. Los temas fundamentales que fueron seleccionados para este libro y que dan solución a algunos de los problemas básicos de la Filosofía del Derecho, son: a. El pensar como valor del conocimiento de la realidad jurídica (problema gnoseológico). b. El ser, del saber de la Ciencia del Derecho (problema ontológico). c. El obrar, que hace referencia al valor de los actos humanos en relación con el objeto material y formal del Derecho, como finalidad que le es propia al saber del jurista (problema ético), siendo de mayor importancia el primero, en cuanto el valor de las soluciones que se dan al problema ontológico y ético del ser del Derecho depende de la orientación que han de seguir las investigaciones sobre los problemas planteados.

St. Thomas says: “The study of philosophy is not that we may know what men have thought, but what the truth of things is.” Therefore, the present book is developed from Philosophical Realism -as a system of thought-, in order to select topics that can be relevant for those who are dedicated to studying the Philosophy of Law, where knowledge is oriented towards the real, towards the natural truth. Consequently, it must be remembered that there will always be a conquered truth where there has been a real knowledge based on the study of reality, independently from the thinking subject and not at the risk of the same. The fundamental topics selected for this book that provide a solution to some of the basic problems of the Philosophy of Law are: a. Thinking, as a value of the knowledge of legal reality (gnoseological problem). b. Being, as a value of the knowledge of legal science (ontological problem). c. Acting, which refers to the value of human actions in relation to the material and formal object of law, as a purpose that is proper to legal knowledge (ethical problem), the first being of greater importance, while the value of solutions given to the ontological and ethical problem of being in Law depends on the orientation given to research on the formulated problems.
